If you are using our services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Description of Services

CheckTeaApp provides the following services:

• Tea App Search Service ($149): Manual search service to determine if your information appears on Tea Dating Advice app or related platforms. Results delivered within 24 hours via email.
• DMCA Takedown Referral Service ($299): Referral service connecting you with qualified attorneys for potential DMCA takedown requests.

4. Not a Law Firm - No Attorney-Client Relationship

CHECKTEAAPP IS NOT A LAW FIRM AND DOES NOT PROVIDE LEGAL ADVICE, LEGAL SERVICES, OR LEGAL REPRESENTATION.

• No attorney-client relationship is created between you and CheckTeaApp by using our services or website.
• Communications with CheckTeaApp are NOT protected by attorney-client privilege.
• We do not provide legal opinions, legal strategy, or legal recommendations.
• For DMCA services, we refer you to independent attorneys who may choose to represent you. Any attorney-client relationship is between you and that attorney only.
• We cannot and do not guarantee that any attorney will accept your case or that any legal action will be successful.

5. Service Limitations and No Guarantees

Our services are provided on an "AS IS" and "AS AVAILABLE" basis. We make no guarantees regarding:

• Completeness or accuracy of search results
• Success of any DMCA takedown request
• Response or compliance by third-party platforms
• Timeframes for legal proceedings
• Any specific outcome or result

Search results depend on publicly available information and platform accessibility. Databases change frequently, and some information may be private, restricted, or inaccessible.

6. User Representations and Warranties

By using our services, you represent and warrant that:

• All information you provide is accurate, complete, and truthful.
• You have a good faith belief that content you request to be removed infringes your rights.
• You are the owner of any copyrighted material or are authorized to act on the owner's behalf.
• You understand that filing false DMCA claims may result in legal liability under 17 U.S.C. § 512(f).
• You will not use our services for any unlawful purpose or to harass others.
• You are not using our services to file fraudulent or bad faith claims.

7. Payment Terms

All fees are due at the time of purchase. Payments are processed securely through Stripe. By providing payment information, you authorize us to charge the applicable fees.

Refund Policy: We offer a money-back guarantee for our search service if you are genuinely unsatisfied with the thoroughness of our search. Refund requests must be made within 7 days of receiving your report. Refunds are at our sole discretion. For DMCA referral services, refunds are subject to the policies of the independent attorneys handling your case.

8. Limitation of Liability

• CHECKTEAAPP'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
• IN NO EVENT SHALL CHECKTEAAPP BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES.
• WE ARE NOT LIABLE FOR ANY ACTIONS OR INACTIONS OF THIRD PARTIES, INCLUDING ATTORNEYS, PLATFORMS, OR OTHER SERVICE PROVIDERS.
• WE ARE NOT LIABLE FOR ANY UNSUCCESSFUL LEGAL OUTCOMES, PLATFORM RESPONSES, OR THIRD-PARTY DECISIONS.

9. Indemnification

You agree to indemnify, defend, and hold harmless CheckTeaApp, its officers, directors, employees, agents, licensors, and service providers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of our services; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights; (d) any false, misleading, or inaccurate information you provide; (e) any DMCA claims you file through our service; or (f) any dispute between you and a third party.

10. Arbitration Agreement and Class Action Waiver

Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or our services, including the determination of the scope or applicability of this agreement to arbitrate, shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules.

Class Action Waiver: YOU AND CHECKTEAAPP AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

Opt-Out: You may opt out of this arbitration agreement by sending written notice to support@checkteaapp.com within 30 days of first using our services. Your notice must include your name, address, and a clear statement that you wish to opt out of this arbitration agreement.

Small Claims Exception: Notwithstanding the above, either party may bring an individual action in small claims court.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. For any disputes not subject to arbitration, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Delaware.

12. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

13. Assumption of Risk

You acknowledge and agree that using our services involves inherent risks, including but not limited to: the risk that search results may be incomplete or inaccurate; the risk that legal claims may be unsuccessful; the risk of counter-notices or legal responses from third parties; and the risk that content removal may not be permanent. You assume all such risks associated with using our services.

14. Communication Consent

By submitting any form on this website, you consent to receive communications from us and any referred attorneys via email, phone calls, and text messages at the contact information you provided. This may include service updates, promotional messages, and case-related communications. Your consent is not a condition of purchase.
